These Terms of Service ("Terms") govern your access to and use of the Fitness AI mobile application and website (collectively, the "Services"), operated by Fitness AI ("we", "us", or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Services.

Account Registration

To access certain features of our Services, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use a strong password (using a combination of upper and lowercase letters, numbers, and symbols) for your account.

Use of Services

Our Services provide fitness and nutrition recommendations tailored to your profile information. These recommendations are generated using algorithms and artificial intelligence. You understand and agree that:

• The Services are not a substitute for professional medical advice, diagnosis, or treatment

• You should consult with a qualified healthcare professional before starting any fitness program

• You use the Services at your own risk

• Results may vary based on individual effort, body composition, and other factors

Subscription and Billing

Some features of our Services require a subscription. By subscribing to our premium services, you agree to the following:

• Payment will be charged to your Apple ID account or Google Play account at confirmation of purchase

• Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period

• Your account will be charged for renewal within 24-hours prior to the end of the current period

• You can manage your subscriptions and turn off auto-renewal by going to your account settings after purchase

• No refund is provided for the unused portion of any term

Data Collection and Analytics

To improve our Services and understand how they are used, we collect anonymous usage data and analytics. This includes:

• Anonymous user behavior and interaction patterns within the app

• Device information and performance metrics

• Feature usage statistics and app performance data

• Aggregated, non-personally identifiable analytics

We do not share, sell, or distribute this anonymous data to any third parties. This information is used solely for internal analytics to enhance user experience, improve app functionality, and guide product development decisions.

User Content

Our Services may allow you to post, upload, or submit content such as progress photos, workout data, and comments ("User Content"). By providing User Content to our Services, you:

• Grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content

• Represent that you own or have the necessary rights to such content

• Agree not to post content that is illegal, offensive, or violates any third-party rights

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Fitness AI and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach the Terms. Upon termination, your right to use the Services will immediately cease.

Limitation of Liability

To the maximum extent permitted by law, in no event shall Fitness AI, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content.

Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law provisions.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
